Beschreibung:
In March 2004, the French parliament overwhelmingly enacted a law to prohibit public school students from wearing clothing and insignia that "conspicuously manifest a religious affiliation". The French ban on headscarves and other religious attire has been heavily publicized in the United States. Americans have resoundingly criticized the French for what they perceive to be a fresh outbreak of religious intolerance. Americans, in thinking and talking about the new French law, usually are quick to point out the superiority of American law, assuming that the wearing of headscarves by Muslims in the nations' public schools is protected by the Free Exercise Clause, which is located within the First Amendment to the U.S. Constitution. Generally speaking, this is true. But it is considerably more complex than this. In France, any religious activity in public space is a threat to society's commitment to laicite and church-state separation. In the United States, however, religious activity in public space is proscribed only when government is sponsoring or promoting the activity. These specific issues, as the courts in the United States have handled them, will be addressed in this article.
